Commercial License EULA

Our Commercial License is designed to be easily understood. The license price is solely based on the size of the Licensee's company (i.e., the entity or organization that will use the Fonts). After purchase, you are entitled to use the Fonts commercially for various purposes, including on desktop computers, printed materials, advertisements, websites, applications, physical products, clothing, logos, and broadcasts.

You are not permitted to modify the fonts files or redistribute the fonts in any form. The use of fonts for Software as a Service (SaaS) that provides fonts access to users outside your company's staff and employees is also prohibited. License pricing is based on the actual size of the end-user company.

Complete End User License Agreement (EULA)

General Terms

This End User License Agreement (hereinafter referred to as "Agreement") is a binding contract between Mujahid Al Fikri and you, as the Licensee (the entity or organization on whose behalf the Fonts is used, as your name is listed during the purchase or sale process). By purchasing, downloading, installing, or using the Fonts (computer software that represents typeface design) in any way, you agree to all the terms in this Agreement.

Upon receiving full payment for all applicable license fees, Mujahid Al Fikri grants you limited, non-exclusive, and non-transferable rights to use the Fonts in accordance with the terms in this Agreement. You acknowledge and agree that all rights not expressly granted to you in this Agreement are expressly reserved by Mujahid Al Fikri.

Definitions

Licensee Size: Refers to the number of employees, including temporary staff, working for the Licensee.

Designer: Refers to an entity (such as a design agency, studio, individual designer, or other service bureau) providing services to the Licensee that involve the use of the Fonts.

Subcontractor: Refers to any third party using the Fonts on behalf of the Licensee. Unless the Designer and Licensee are the same entity (i.e., the Designer creates work for their own organization), the Designer is considered a Subcontractor of the Licensee.

License Scope

The Commercial License allows you to use the Fonts within your organization. The Fonts is provided in OTF (OpenType CFF) and WOFF formats. Alternative formats may be provided upon request, at the discretion of Mujahid Al Fikri.

Unless otherwise specified in this Agreement, you are permitted to:

  • Install the Fonts on any number of devices within your organization;
  • Use the Fonts on any number of websites owned and controlled by your organization;
  • Embed the Fonts in static documents (such as PDFs), in eBooks, digital products, installable applications, clothing, and other media produced by your organization.

You may only serve the Fonts on websites using CSS @font-face rules and in WOFF and WOFF2 formats. The use of the Fonts in OTF format on the web is not permitted.

Commercial License fees are determined based on the Licensee Size. The Commercial License remains valid if the Licensee Size increases, provided that the Licensee Size was correctly stated at the time of purchase.

Subcontractors

The Commercial License permits a number of Subcontractors to use the Fonts, in accordance with this Agreement, on behalf of the Licensee. You are permitted to send copies of the Fonts to Subcontractors for this purpose. You must ensure that each Subcontractor has read and agreed to the terms of this Agreement before receiving the Fonts.

If a Subcontractor ceases to work for the Licensee, they must destroy all copies of the Fonts in their possession. Subcontractors are not permitted to use the Fonts on behalf of themselves or any other party other than the Licensee. Unless specifically exempted by Mujahid Al Fikri, Subcontractors must not be subsidiaries or parent organizations of the Licensee.

Purchase by Designer

A Designer may purchase a Commercial License on behalf of a Licensee (their client), provided that:

  • The Licensee and Licensee Size are correctly identified during the purchase process;
  • The Licensee has read and agreed to the terms in this Agreement;
  • The Licensee has expressly authorized the Designer to complete the purchase on their behalf.

Designers are not permitted to charge or invoice the Licensee at a price other than the actual amount they paid for the license.

General Restrictions

You must take all reasonable precautionary measures to ensure the Fonts cannot be accessed by unlicensed third parties or the general public. The Fonts must not be uploaded to online storage platforms (such as GitHub or Amazon S3) where the Fonts can be accessed by unlicensed third parties.

You are not permitted to:

  • Decompile, modify, reverse-engineer, reformat, alter, edit, or create derivative works from the Fonts, or engage any third party to do so without prior written permission from Mujahid Al Fikri;
  • Distribute (share, rent, lend, gift, sell, sublicense, etc.) the Fonts or copies thereof to any unlicensed third party;
  • Transfer this Agreement or your rights therein to any third party without prior written permission from Mujahid Al Fikri;
  • Use the Fonts in any application that allows unlicensed third parties to use it to customize their own designs or to create static documents or images (e.g., online design applications, hot-type products, or print-on-demand services).

Term

This Agreement is perpetual, unless you violate any of its terms. In the event of a violation, Mujahid Al Fikri has the right to charge you license fees that cover your actual usage, based on each violation and without discount, and/or terminate the license.

Warranty

Mujahid Al Fikri represents that they are the sole owner of all rights to the Fonts licensed to you under this Agreement, and the rights granted are free from any third-party rights. Nothing in the Fonts infringes or will infringe upon any copyright or other third-party right or violate any contract with a third party. Mujahid Al Fikri has full power, right, and authority to enter into this License, and is not aware of any reason why the license mentioned above would not be valid or enforceable.

Mujahid Al Fikri makes no warranties, either express or implied, regarding merchantability, fitness for a particular purpose, or otherwise. If you encounter problems or difficulties with the Fonts, Mujahid Al Fikri will endeavor in good faith to provide corrections or replacements within 30 days of being notified. If the issue cannot be reasonably fixed, Mujahid Al Fikri may, at its discretion, offer you a refund, at which point this Agreement will immediately terminate.

Mujahid Al Fikri is not liable to you or any third party for any direct, indirect, consequential, or incidental damages arising from the use or inability to use the Fonts, even if previously notified of the possibility of such damages. Under no circumstances will Mujahid Al Fikri's liability exceed the license fee you purchased. You agree to indemnify and hold Mujahid Al Fikri harmless from any claims or damages that may arise from your misuse of the Fonts or violation of this Agreement.

Limitation of Liability

Except for liability arising from your indemnification obligations, under no circumstances will either party's liability exceed the license fee purchased.
